UK Frontier Worker Permit

UK Frontier Worker Permits are available to European, EEA and Swiss citizens who are not primarily residing in the UK but who are working or are self-employed in the UK. Additionally, from 1 July 2021, it will be mandatory for all Frontier Workers to hold a Frontier Worker Permit to enter and stay in the UK under the Frontier Worker route.

Overview of UK Frontier Worker Permit requirements for an applicant

To qualify for a Frontier Worker Permit, the applicant will need to satisfy UK Visas & Immigration the following:

  • The applicant is an EEA, EU or Swiss citizen
  • The applicant is not primarily resident in the UK
  • The applicant is a worker or self-employed person in the UK or has retained a worker or self-employed person in the UK
  • All the above requirements were met prior 31 December 2020 and have been met after continuously

Not Primarily Resident in the UK

The applicant will be considered as ‘not primarily resident’ in the UK if:

  • The applicant have been physically present in the UK for less than 180 days in any rolling 12 month period. The rolling period considered, will be between 1 January 2020 and the date your application is considered.
  • The applicant have been present in the UK for more than 180 days in any rolling 12-month period. The rolling period considered, will be between 1 January 2020 and the date your application is considered. There are also some exceptional reasons for not being able to travel to your country of primary residence once in every 6-month period or twice in every 12-month period.
  • The applicant have been present in the UK for more than 180 days in any rolling 12-month period. The rolling period considered, will be between 1 January 2020 and the date your application is considered but have returned to your country of primary residence at least once in every 6-month period or twice in every 12-month period

Worker or Self-employed Person

Any person willing to qualify as a Frontier Worker must have worked or been engaged in self-employment in the UK at least one time in the 12 month period before 31 December 2020.

To maintain the status as a Frontier Worker, the person must continue to come for work or self-employment at least once in every rolling 12-month period in the UK. The work or self-employment must be genuine.

If a person have not been present in the UK as a worker or self-employed person for a period of 12 months it is still possible to qualify for the Permit being a retained worker or self-employed person. In order to do so, the person must have become unemployed for one of the reasons below:

  • Temporarily unable to work in the UK due to illness
  • Duly recorded involuntary unemployment
  • Involuntarily unemployed and have embarked on vocational training
  • Pregnancy or childbirth
  • Voluntarily stopped working to start vocational training

Obtaining ILR via staying on UK Skilled Worker Visa

The Frontier Worker Permit does not lead directly to the settlement and ILR in the United Kingdom. If your goal is to pursue settlement, we suggest considering to make an application for Pre-Settled Status or Settled Status under the EU Settlement Scheme.
