Qualifying Investment Options for UK Investor Visa

Under the UK Investor Visa immigration category, the investor is required to have access to at least £2 million to invest in the UK. To make the application process clearer, Mann’s Solutions team has prepared an overview of qualifying investment options.

  • The applicant must have access to £2 million for investing in the UK

The funds must be invested in qualifying investments, which include:

  • Share capital or Loan capital 

The investor can choose to invest in, for example, incorporate bonds. The investment must be made inactive and trading UK registered companies.

  • Pooled investment vehicles 

The investor also can invest in pooled investment vehicles that receive funding from the UK government, or, for example, a devolved government department or one of the agencies.

What companies are considered as “active and the trading UK registered companies”?

  • To be considered eligible for the investment, the company must:
  • be registered in the UK with Companies House;
  • be registered with HMRC for corporation tax and PAYE;
  • have a registered office in the United Kingdom;
  • have a UK business bank account showing regular transactions and trade;
  • have at least 2 employees based in the UK (the employees must have a lower position than a director)

How to Obtain a British Passport via Tier 1 Investor Visa?

Indefinite leave to remain holders can apply for naturalisation one year after the grant of settlement (ILR) and become British citizens.

  • The requirements for citizenship are as follows:
  • The applicant must have passed English Language and Life in the UK test
  • The applicant must be of good character and not have breached any immigration rules in the UK
  • The applicant must have spent no more than 450 days outside the UK in the 5 years before the application
  • The applicant must have not spent more than 90 days outside the UK in the 12 months before the application for
  • Naturalisation

Different requirements apply to Tier 1 Investor who applied to enter the category under the Immigration Rules in force before 6 November 2014 and 29 March 2019.

UK Innovator Visa Applications hit the Record Quarter by rising to 187%

Comparing to the same quarter a year ago, amount of Innovator Visa applications has risen to 187% with 66 investors and 117 dependent applicants in the second quarter of this year.

The total investment amount equaled GBP 132 million during spring months and June and brought around GBP 222 million later this year. The rise of the applications is mainly connected to UK’s Covid-19 restriction lifting. Among the top applicant are Chinese, Hong Kong, Russian, and United States investors.

About Innovator Visa

The Innovator visa is for non-EEA nationals who are experienced businesspersons seeking to establish a business in the UK. In most cases, the applicant will need to have access to at least £50,000 to invest in their business or have already invested £50,000 in your business, but certain exceptions apply. The applicant will also need to have an innovative, viable, and scalable business idea that is approved and supported by an endorsing body.

Innovator Visa UK eligibility requirements:

  • The applicant is at least 18 years old
  • Applicant’s endorsement letter was issued not more than 3 months before the date of their Innovator visa application
  • The applicant is competent in the English language to at least CEFR Level B2, equivalent to IELTS 5.5 in reading, writing, listening and speaking
  • Applicant has at least £50,000 available to invest in their UK business or have already invested £50,000 in your UK business
  • Applicant has been endorsed by an approved UK endorsing body that has assessed their business idea for innovation, viability and scalability
  • Applicant is capable of undertaking, any work or business activity in the UK stated in their application
  • Applicant must have at least £1,270 available to support themselves and £285 for partner, £315 for one child or £200 for each additional child without relying on public funds

What else do you need to know?

Applicant’s partner and any children under the age of 18 may accompany or join them as dependents. Applicants can be the sole founder of their business and they can be a member of an innovator team. Each applicant must receive their own individual endorsement from an approved endorsing body, in order to satisfy the investment funds required for a new business endorsement, each applicant must have at least £50,000 investment funds each.

ILR and Settlement

Initial Innovator visa will be granted for 3 years, it will be possible to extend an Innovator visa for periods of 3 years at a time. The applicant will be able to apply for indefinite leave to remain after spending 3 years in the Innovator visa category

What Document you Must Provide to Obtain Tier 1 Investor Visa?

Investor Visa, especially popular among our Honk Kong and Chinese clients, is not only the fastest route to settlement in the UK but also opens many opportunities for investors. Initially designed for high-net-worth individuals who can invest from £2,000,000 in the UK, Investor Visa offers an opportunity to settle in the UK only after 2 years, with a £10 million investment. 

Please find below the document needed to apply:

* For any documents that are not in English or Welsh, the applicant will need to provide a certified translation.

Evidence of investment funds

When using your own money for the Investment, the applicant will have to show:

  • The amount of money he has and where it’s being held
  • Proof of where the money came from if you’ve had the money for less than 2 years
  • That the money can be transferred to the UK 

Proof of UK Bank Account

The investor will have to provide a letter that must be:

· Dated within 3 months of the application

· Be on the official headed paper of the UK bank

· Letter should state name and account number

· Confirm that the bank is regulated by the Financial Conduct Authority

· Confirm the account was opened with the bank to invest £2,000,000

· Confirm that the checks for money-laundering have been carried out

 

Alongside the above-mentioned documentation, the investor will need to meet the following requirements:

 

· Must be 18 years old or over

· Have access to at least £2,000,000 in investment funds, which has been held for a consecutive 2-year period

· No English language requirements for initial application

· No individual maintenance requirement

· Applicant and any adult dependents will need to provide an overseas criminal record certificate for any country that they have lived in for at least 12 months in the last 10 years

· Can work and study

UK Innovator Visa Explained

The Innovator visa is for experienced businesspersons seeking to establish a business in the UK. In most cases, the applicant will need to have access to at least £50,000 to invest in their business. Mann’s Solutions team prepared answers to the most common questions regarding the Innovator Visa.

1. Should I apply for the Innovator or Start-up category?

Our immigration advisers will help you with the right decision, as the right category will depend on your current circumstances and long-term goals in the UK. To make things clear, the Innovator route has a quicker route to settlement, however will require initial funding of at least £50,000. On the other hand, the Start-up route has a lower threshold for entry but allows more flexibility as individuals in this category are permitted to take other employment while their business gets up and running.

2. Is there an investment funds requirement?

The investor will need to have at least £50,000 available to invest in UK business and may rely on their own savings or funding provided by the endorsing body. However, the requirement to have a ‘viable’, ‘scalable’ business idea means that the investor may need to have more than £50,000 available for the investment. 

3. What do I need to know about Endorsing Bodies?

The Home Office has a list of endorsing bodies for Innovator visa applications that contains the names of all currently approved Innovator visa endorsing bodies, as well as links to their websites. To apply for a visa, the applicant will need to be endorsed by an approved UK endorsing body, Venture Capital Firms via submitting a business plan with the relevant idea, which is innovative, viable, and scalable.

4. Which endorsing body should I apply to?

The right endorsing body for your application will depend on your individual case and requirements. What needs to be considered is the field in which your business will operate, the timing of the application, location, and what support the business may require.

5. What documents have to accompany the endorsement letter?

For a new business endorsement, the endorsement letter must include the following documents:

– The endorsing body name

– Endorsement reference number

– Date of issue must be no earlier than the three months before the date of the application

– Applicant’s name, date of birth, nationality, and passport number

– Short description of the proposed business venture, products, and services it will provide

– Name and contact details of someone within the endorsing body who will certify the contents of the endorsement letter to the Home Office

– Proof the business is innovative, viable, and scalable as set out in the part W6 of Appendix W in the Rules

– Satisfy the endorsing body that the applicant will devote their entire working time to the UK developing business ventures

 6. Are there any restrictions regarding the business the investor can set up?

Your business idea may relate to any sector, provided the business idea is sufficiently innovative, viable, and scalable. Applicants can also develop other businesses as well as their main business idea.

7. How long will be valid Innovator visa once approved?

The initial Innovator visa will be granted for 3 years.

8. Will I be able to apply for ILR?

The investor will be able to extend an Innovator visa for periods of 3 years initially. There is no maximum time limit in the Innovator category. Moreover, visa holders will be able to apply for ILR (indefinite leave to remain) after spending 3 years in the Innovator visa category.

9. Are there any residency requirements for ILR application?

To qualify for indefinite leave to remain (ILR) the applicant has to spent not more than 180 days outside the UK in any rolling 12 month period, during the last 3 years prior to the application.
