Long Residence ILR Application: Guidelines and General Questions

Applicants who stays in the UK for 10 years or more asking us what the requirements for a successful application are.

Long residence route to indefinite leave to remain (ILR) provides a route to settlement based on continuous lawful residence in the UK for a period of 10 years.

  1. What requirements for 10 Years Long Residence ILR are for applicant

Applicant needs to satisfy UK Visas and Immigration in order to make a successful application and obtain indefinite leave to remain (ILR) on the ground of 10 years long residence, all of the following below:

  • Applicant has spent a period of at least 10 years residing in the United Kingdom continuously and lawfully
  • Applicant’s 10 years period of lawful residence is unbroken
  • There are no public interest reasons why it would be undesirable to grant their indefinite leave to remain
  • There are no general grounds for refusing applicant’s application
  • Applicant has demonstrated sufficient knowledge of the English language and about life in the United Kingdom
  • Applicant is not in the United Kingdom in breach of immigration laws

In order to qualify for indefinite leave to remain on the basis of the 10 years long residence rule, applicant must have at least 10 years continuous lawful residence in the UK. This can include periods including temporary admission and periods where they have enjoyed section 3C leave.

Lawful residence includes a period with:

  • Existing leave to enter or remain
  • Temporary admission where leave is subsequently granted
  • An exemption from immigration control

Continuous residence will be broken for the purpose of a 10 years long residence ILR application if the applicant has:

  • Been absent from the UK for a period of more than 6 months at any one time
  • Spent a total of 18 months outside the UK throughout the period
  • Left the UK with no valid leave to remain on departure from the UK and did not apply for entry clearance within 28 days of that leave expiring
  1. What are absences and time spent outside the UK for an applicant

Applicant must follow the requirements for an application for ILR based on 10 years continuous and lawful long residence, based below:

  • Not been absent from the UK for 6 months or less at any one time
  • Had existing leave to enter or remain when you left and returned
  • Departed the UK before 24 November 2016, but after the expiry of your leave to remain, and applied for fresh entry clearance within 28 days of that previous leave expiring, and returned to the UK within 6 months
  1. Which documents required for A 10 Years Long Residence for an Applicant

Applicant must have all evidence in order to make successful application to Home Office, so it will consider their application for ILR, Home Office will consider any UK exit and entry stamps in applicant’s passports and landing cards. Only full days will count as absences and there is no need to include any days on which applicant entered or departed the UK.

There are some of the documents to demonstrate their continued residence in the UK, including but not limited to:

  • Evidence of accommodation, tenancy agreements or mortgage statements
  • Utility bills
  • Bank statements
  • Evidence of education or employment
  • Travel tickets and receipts

If applicant’s aged 18 and 65 years old, their 10 years long residence ILR application must demonstrate that they have sufficient knowledge of the English language and have passed the Life in the UK test. The current Home Office fee for an application for ILR on the basis of the 10 years long residence rule is £2,389.

  1. How Long Does Indefinite Leave To Remain (ILR) Last For?

Once applicant has been granted indefinite leave to remain, it will not expire, unless if they spend more than 2 years outside the UK then they may lose ILR.
