Fiance visa or fiancee visa is allowing a person to come to the UK to marry. Applicant who is planning to marry a British citizen or settled person in the UK may apply for a fiance visa in order to do this.

One of the most important requirements of this visa, applicant must marry their fiancée or register their civil partnership within 6 months of applicant’s arrival. They can apply to switch into Spouse visa if they would like to stay in the UK.

In order to be qualified for a fiance visa applicant must satisfy the following criteria:

  • Applicant and partner are both aged 18 or over at the date of the application
  • They have met in person
  • Their relationship is genuine and they both intend to live together permanently
  • Any previous relationship that either of they had broken down permanently
  • There will be enough accommodation for applicant and anyone else who lives with them without relying on public funds, both before and after the marriage or civil partnership
  • Applicant can speak and understand English to the required standard
  • Applicant meet the UK Border Agency’s financial requirement or meet the financial adequacy test

UK Fiance visa – Financial requirements

Applicant will need to show that their partner in the UK has a gross annual income of at least £18,600. If they are also bringing a child with them (who is not British, an EEA national or otherwise settled in the UK), their spouse or partner’s gross annual income will have to be £22,400. For each additional child, add £2,400 to this total to see how much income your spouse or partner will need to have.

Also, Applicant can meet the Fiance visa UK financial requirement through their partner’s salaried and non-salaried income, self-employed income, salary and/or dividends from a company of which they are a Director, property rental income, dividends and income from investments, stocks, shares, bonds or trust funds, pension income, insurance payments, maintenance payments and cash savings above £16,000 that have been held for at least six months, unless they can demonstrate that they have come from the sale of property or investments within the last 6 months.

Different considerations will apply if your partner is in receipt of certain benefits.

UK Fiance Visa – Visa Application, Home Office Fees and process time

The Home Office application fee for a UK Fiance visa application submitted outside the UK is currently £1,523. Home Office aims to process 95% of UK Fiance visa applications within 3 months or 12 weeks.

If applicant require a faster visa processing timeline, most visa application centres outside the UK offer a Settlement Priority Visa Service. The visa processing time for a UK Fiance visa application submitted via the Settlement Priority Visa Service is normally not more than 30 working days.

Applications for Fiance visas can only be made from outside the UK.  It is not possible to switch into the Fiance visa category from within the UK. If their application for a UK Fiance visa is successful, applicant’s visa will be valid for 6 months. Fiance visa holders are not permitted to work in the UK.

After applicant’s wedding has taken place, you will then be eligible to apply to switch into the Spouse category without having to leave the UK.
