Tier 2 Sponsor Licence: Requirements to obtain the Licence

A Tier 2 Sponsor Licence established by UKVI is required by businesses seeking employees from outside the UK. There is a strict application process which will include a visit from UK Visas and Immigration (UKVI). Once granted, the tier 2 sponsor licence must be renewed annually for a fee.

There are two main types of tier 2 sponsor licences (excluding sportsperson and religious ministry licences), these are:

  • Tier 2 (General) sponsor licence; and
  • Tier 2 Intra-Company Transfer (ICT) sponsor licence

 

An employer can make an application for either sponsor licence or both simultaneously and they can also apply at different times.

The tier 2 ICT licence has an advantage over the tier 2 (General) licence in that if your company has an overseas department and wishes to transfer an employee from that country, it can usually do so far quicker. There is no need to advertise the vacancy in order to satisfy the “Resident Labour Market Test” and neither do you need a “Restricted Certificate of Sponsorship”. However, unlike a tier 2 (general) application, it will not lead to indefinite leave the remain in the UK.

 

Resident Labour Market Test (RLMT)

The RLMT ensures settled workers in the UK have the opportunity to apply for employment roles before they are offered to a migrant. In order to satisfy the RLMT the post must have been advertised for a minimum period of 28 days in two places listed in the sponsor guidance issue by UKVI, e.g. national newspapers, recruitment agencies, or online.  There are various exemptions and qualifying criteria which you can find on the Gov.uk website.

 

Business requirements for a Sponsor Licence

There is no requirement that the business needs to be of a particular size before applying for a tier 2 sponsor licence, or that it must have been trading for a certain amount of time. This means that start-up businesses are also eligible to apply. The business should already be legally operational, and there should be someone available and resident in the UK to deal with any queries from the Home Office UKVI. In practice, there will typically be one or two key personnel (e.g. an authorising officer, a key contact and a level 1 user) who have been appointed and working in the business. A level 1 user, oversees the day-to-day management of the Tier 2 sponsorship licence using the Sponsorship Management System (SMS).

 

Other requirements:

  • There should be a genuine need for the employee
  • The business HR systems can manage the sponsorship duties
  • The business is offering employment suitable for tier 2 skill requirements that meet the minimum salary guidelines

 

Applying for a Sponsor licence

To apply for Tier 2 Sponsor Licence, you will need to complete an online application form and submit it to the Home Office along with supporting documentation. It is extremely likely that immigration officials from the Home Office will visit and examine your HR systems to check for compliance and your eligibility for Tier 2 Sponsor Licence.

 

Documents required but not limited to are:

  • Recent bank statements for your business
  • Employers liability insurance documents from an authorised supplier of at least 5 million
  • Proof of business registration with HMRC including the PAYE and Accounting Office Reference Number
  • Evidence of ownership or lease of business premises
  • Latest audited/non audited accounts (signed)
  • Any mandatory evidence required from regulatory bodies specific to the business sector

 

There is a fee for a tier 2 sponsor licence application which depends upon the size of the business:

  • For a large sponsorship annual licence the fee is £1,476
  • For a small sponsorship annual licence the fee is £536

 

It generally takes approximately 8-10 weeks for the sponsor licence application to be processed, during which time you will probably be visited by the Home Office Compliance Officer who will undertake a pre-licence audit. Once you have obtained a tier 2 sponsor licence it is valid for four years.

American Investors among the top Applicants for Portugal’s Golden Visa

American Investors are among the top Applicants for Portugal’s Golden Visa in 2020. At the end of November 2020, the golden visa investment amounted to 619 million euros. The top five applicant groups this month were Chinese (22), Americans (12), Brazilians (9), South Africans (5), and Indians (4). Only this November investments amounted 50 million euros, which is a 74% increase comparing to October, however a 35% decrease compared to November 2019.

The growing interest in investment immigration is one of the trends among American millionaires, who probably feel that their mobility can be improved.

This ongoing presence in the top 5 most likely will result in Americans being included in the annual top 5 when the SEF releases its full-year 2020 figures at the end of 2020.

Innovator Visa: Documents that accompany the Endorsement Letter

To make your Innovator Visa application easier, we have prepared a detailed list of documents that have to accompany your Endorsement Letter. Before making an application for an innovator visa, you will need to apply for and obtain an endorsement letter from a UK Visa and Immigration (UKVI) approved endorsement body. They will assess your business idea and carry out a credibility assessment on behalf of the Home Office.

For a new business endorsement, the endorsement letter must include the following documents:

  • The endorsing body name
  • Endorsement reference number
  • Date of issue which must be no earlier than the three months before the date of the application
  • Applicant’s name, date of birth, nationality and passport number
  • Short description of the proposed business venture, products and services it will provide
  • Name and contract details of someone within the endorsing body who will certify the contents of the endorsement letter to the Home Office
  • Proof the business is innovative, viable, and scalable as set out in the part W6 of Appendix W in the Rules
  • Satisfy the endorsing body that the applicant will devote their entire working time to the UK developing business ventures

For an existing business endorsement the endorsement letter must include the following documents:

  • The endorsing body name
  • Endorsement reference number
  • Date of issue which must be no earlier than the three months before the date of the application
  • Applicant’s name, date of birth, nationality and passport number
  • Short description of the business venture, products and services it provides
  • Name and contract details of someone within the endorsing body who will certify the contents of the endorsement letter to the Home Office
  • The applicant can demonstrate significant achievements which are judged against the business plan assessed in their prior endorsement documents
  • The business is registered with Companies House and the applicant is a director or member of the business
  • Evidence the business is active and trading
  • The business has been sustained for the last twelve months (at least) based on consideration of its assets, expected income juxtaposed between current and proposed expenses
  • The applicant can prove an active role in the daily management and development of the business
  • Satisfy the endorsing body that the applicant will devote their entire working time to the UK developing business ventures

 

Documents that accompany the endorsement letter:

Alongside the endorsement letter for Innovator Visa, you will also need to provide the following documents:

  • Comprehensive detailed business planand strategy (for new business ventures)
  • A valid passport or identity documentation that shows your identity and nationality
  • Bank statements confirming you had at least £1,270 in savings in a bank account for twenty-eight consecutive days before making the application for an innovator visa.
  • Evidence that you meet the English language requirement
  • Proof of your investment funds in cases that involve new businesses
  • Tuberculosis test results if you come from a country where you have to take the test
  • certified translation of every document that is not in English or Welsh.

 

You will need a blank page in your passport for your Innovator visa if you are coming from outside the EU, Switzerland, Norway, Iceland, or Liechtenstein and from within those countries if your passport does not contain a biometric chip.

You may also be required to produce further documentation depending on your circumstances.
